1. Acceptance of Terms
By accessing and using TradeXblue ("the Company", "we", "us", or "our"), you agree to be bound by these Terms and Conditions, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site.
2. Use License
Permission is granted to temporarily access and use TradeXblue for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
- Modify or copy the materials;
- Use the materials for any commercial purpose;
- Attempt to decompile or reverse engineer any software contained on the website;
- Remove any copyright or other proprietary notations from the materials; or
- Transfer the materials to another person or "mirror" the materials on any other server.
3. Account Registration
To access certain features of our platform, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. 4. Trading Risks
Trading foreign exchange on margin carries a high level of risk and may not be suitable for all investors. Before deciding to trade foreign exchange, you should carefully consider your investment objectives, level of experience, and risk appetite. There is a possibility that you may sustain a loss of some or all of your investment and therefore you should not invest money that you cannot afford to lose.
4.1 Risks of Investing in CFDs
CFDs, especially when highly leveraged, carry a very high level of risk. They are not standardized products. Different CFD providers have their own terms, conditions and costs. Therefore, generally, they are not suitable for most retail investors.
4.2 Liquidity Risk
Liquidity risk affects your ability to trade. It is the risk that your CFD or asset cannot be traded at the time you want to trade (to prevent a loss, or to make a profit).
4.3 Execution Risk
Execution risk is associated with the fact that trades may not take place immediately. For example, there might be a time lag between the moment you place your order and the moment it is executed.
4.4 Internet Trading Risks
There are risks associated with utilizing an Internet-based deal execution trading system including, but not limited to, the failure of hardware, software, and Internet connection. Since TradeXblue does not control signal power, its reception or routing via Internet, configuration of your equipment or reliability of its connection, we cannot be responsible for communication failures, distortions or delays when trading via the Internet.
5. Risk Acknowledgement
The client acknowledges and declares that they have read, understood and thus accept without any reservation the following:
- The value of the Financial Instrument (including currency pair, CFDs, or any other derivative product) may decrease and the client may receive less money than originally invested or the value of the Financial Instruments may present high fluctuations.
- Information on past performance of a Financial Instrument does not guarantee the present and/or future performance; the use of historic data does not constitute a binding or safe forecast as to the corresponding future return of the Financial Instruments to which such data refers.
- Some Financial Instruments may not become immediately liquid due to various reasons such as reduced demand, and the Company may not be in a position to sell them or easily obtain information on the value of such Financial Instruments or the extent of any related or inherent risk concerning such Financial Instruments.
- When a Financial Instrument is negotiated in a currency other than the currency of the client's country of residence, any changes in an exchange rate may have a negative effect on the Financial Instruments' value, price and performance.
- A Financial Instrument in foreign markets may entail risks different than the usual risks in the markets at the client's country of residence. The prospect of profit or loss from transactions in foreign markets is also influenced by the exchange rate fluctuations.
6. Fees and Charges
TradeXblue reserves the right to charge fees for the use of its services. All applicable fees will be disclosed prior to any transaction. We may, at our discretion, modify fees and charges with reasonable notice provided to users.
7. Limitation of Liability
In no event shall TradeXblue or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on our platform, even if TradeXblue or a TradeXblue authorized representative has been notified orally or in writing of the possibility of such damage.
8. Modifications
TradeXblue may revise these terms of service for its platform at any time without notice. By using this platform, you are agreeing to be bound by the then current version of these terms of service.
9. Governing Law
These terms and conditions are governed by and construed in accordance with the laws and you irrevocably submit to the exclusive jurisdiction of the courts in that location.
